General Terms and Conditions

1. validity
The following General Terms and Conditions apply to all contracts for the provision of individual or group language instruction to private customers (hereinafter referred to as "Customer").

2. conclusion of the contract
The booking of lessons can be made orally, by telephone, by mail, by e-mail or by fax. A legal binding effect, however, only occurs when the contract is signed by the customer. The customer's right to withdraw from the contract ends when the lessons begin.

3. giving of lessons
One lesson lasts 45 minutes, in exceptional cases and by agreement 60 min. Lessons take place all year round, even during state school vacations. If the customer cannot attend lessons, there is no right to make up the lessons. If a customer is unable to attend for a longer period of time, he/she should consider giving notice in writing (see point 7). Absences do not affect the tuition fee. Instruction by specific instructors is not owed. The naming of lecturers, e.g. in programs or the agreement, is therefore only non-binding. We are entitled to substitute lecturers.

4. contractual obligations of the customer
Enrollment fee, course fee and the price for the learning material are to be paid at the contractually agreed time. If there is no special agreement in this regard, the registration fee and the price for the learning material are due upon course registration. The course fees are always payable in advance at the beginning of the course and for a period of 4 weeks at a time. Payment must be made without deductions. Cash discount will not be granted. Absences will not affect the tuition fee. "We do not participate in dispute resolution proceedings before a consumer arbitration board."

5. appointment fixing and postponement, cancellation of lessons/cancellation of lessons
We are entitled to reschedule the beginning and end of a course if necessary. Furthermore, we are entitled to change the lesson times if necessary. In the case of individual lessons, we will consult with the customer before making such changes. If, in the case of group lessons, notified changes or postponements cause difficulties for the customer, we must be informed as soon as possible so that we can reschedule if necessary. In the case of individual lessons, the customer may, in particularly justified individual cases, cancel the lesson times agreed with him no later than 1 pm on the day before the lesson (in the case of lessons on Monday no later than 1 pm on the Friday before). In this case, an alternative date will be determined by us in consultation with the customer. Any agreed lessons that are cancelled after these times or are not taken up without cancellation will be charged without exception.

6. Cancellation
The period of notice is four weeks. In the case of contracts with a fixed period of performance, ordinary termination is excluded. A termination without notice due to a special position of trust according to § 627 BGB does not exist. Any right to extraordinary termination for other reasons shall remain unaffected.

7. Copyright and rights of use
Teaching materials are our intellectual property, or that of the creator.

8. liability for damages
Claims for damages of any kind against us, our legal representatives and vicarious agents are excluded, unless there is intent or gross negligence or the breach of a material contractual obligation.

9. Place of performance and jurisdiction
Place of performance and jurisdiction is Ulm.
